3.4 Refund Process

4. Payment Terms

4.2 All payments must be made in Indian Rupees (INR) unless otherwise agreed
4.3 Late payments may incur additional charges as specified in contracts
4.4 All prices are exclusive of applicable taxes unless stated otherwise

6. Intellectual Property Rights
6.1 Upon full payment, clients receive rights to final deliverables as specified in individual contracts
6.2 digicreate.in retains rights to methodologies, processes, and pre-existing intellectual property
6.3 Clients warrant they have rights to all provided materials and content
6.4 We reserve the right to showcase completed work in our portfolio unless expressly prohibited
7. Limitation of Liability
7.1 Our total liability is limited to the amount paid for the specific service
7.2 We are not liable for indirect, consequential, or punitive damages
7.3 Client assumes responsibility for backup and security of their data
7.4 We do not guarantee specific results from marketing services
7.5 Force majeure events release us from contractual obligations
8. Termination
8.1 Either party may terminate services with written notice as per contract terms
8.2 Immediate termination may occur for breach of terms or non-payment
8.3 Upon termination, all outstanding payments become immediately due
8.4 Confidentiality obligations survive termination
9. Governing Law and Jurisdiction
9.1 These Terms are governed by the laws of India
9.2 All disputes shall be subject to the exclusive jurisdiction of courts in Rudrapur, Uttarakhand, India
9.3 Parties agree to attempt mediation before litigation
9.4 Indian language version of terms shall prevail in case of conflicts
